First they ran Rollye James off the air. Now they ran Art off. As far as I'm concerned they can p**s off. I bought a c crane wireless, and get more than Sirius ever thought of programming. I'm saving $14.95 a month too, and that's not chump change for a guy on a fixed income. What I see in common with Art and Rollye is neither of them would do a commercial for a product that they didn't believe in.

yup, although not sure if they ran Art off or he ran himself off, but yeah, in the end who cares.

However think about how many hosts use it and are happy with it. There is some sort of discrepancy there.

Possibly a political agenda? They both discuss topics that may be uncomfortable to government.

IM NOT SURE WHY THE CONTRACT AND NC CLAUSE IS STILL LEGAL? IF ANYONE CAN EXPLAIN TO ME. ART WAS ON AIR FOR 6 WEEKS, THEN WHATEVER HAPPENED HAPPENED. NEXT THEY WONT WORK WITH ART AND LOOK FOR OTHER SITUATION. COULD THEY NOT KEPT DARK MATTER WITH ANOTHER HOST, DOES NOT GETTING RID OF DARK MATTER NULL ARTS CONTRACT AND THEN ONTOP CHOOSE TO PUT COAST TO COAST BACK UP. IF ART CANT COMPETE AGAINST THERE SHOW DARK MATTER WHICH THEY CANCELED DOES THAT NOT FREE ART BELL FROM HIS CONTRACT. IM SURE A LAWYER WOULD SAY YES.

Guys, Art made it very clear that HE cancelled the show. Not sirius. He agreed to terms of a contract then he broke that contract. Not trying to defend sirius, but this is what happened.

Non-compete agreements are usually a separate contract, so it doesn't matter whether the show fails or succeeds, you still have that agreement.

Now, we don't know the terms of either contract, we don't know much. We do know Art pulled the plug, and we do know that Sirius was under no obligation to give Art special treatment.

SEEMS LIKE BOTH HAVE BREACHED IN SOME WAY WHICH COULD MAKE THIS NC CONTRACT VOID. THEY ARE NOT RUNNING DARK MATTER AND REPLACED IT WITH C2CAM WHICH MAKES HIM UNABLE TO COMPETE WITH A SHOW CALLED DARK MATTER.

Yeah, exactly. That's the whole idea of a "non-compete" clause, which Art voluntarily agreed to when he signed the contract.

From what I understand, Dark matter is Art's show, not Sirius' (because he owned the web domain and used the name liberally himself). Again, we don't know what the NC said, it could have said something like "you will not participate as a talk show host for a period of 2 years from the signing of this contract". They are usually quite vague since how do you write out all the possibilities?

Art pulled his own show from Sirius, and they replaced it with a similar show. Totally legit (and what Art should have assumed may happen).

The contract that was actually breached (we assume - because we have no details or even know if there was a formal contract for doing shows - it seems unlikely actually since there seems to be no repercussion to Art for pulling his show) was the contract for Art to do a show for/on Sirius.

Art has no leg to stand on from what he has said and what we understand. He should not have signed an NC, he almost definitely did not need to, and if Sirius required that he should have thought back to his experience with Premiere's NC and how that kept him off the air for a decade.

Now, with the right lawyers, and endless cash, this might be able to be worked out, but I don't think Art has the money or the inclination to do this.

APPRECIATE ALL THE FEEDBACK. DOES SEEM ALOT ON BOTH SIDES HAVE BEEN STRANGE AND HOPE FOR THE BEST OUTCOME AND NOT ART NEVER DOING A SHOW AGAIN.

I believe Art said somewhere that he wasn't using a lawyer when he initially signed the contract. That just seems crazy to me....

I find it hard to believe that anyone could think that was acceptable, someone like Art who has had lawyer experiences (as he told us), well... WTF?

Since Sirius does not seem to be pursuing Art for breach of contract maybe the deal was no work contract, but sign an NC agreement. I could see Art thinking this was a good deal since he could step out at any time, and if he did step out he would not want to be doing a show anyways, or else why would he step out?

IMO this is the major malfunction to people's thinking about this. If Art wanted to do a show, well, he HAD A SHOW. He gave up his show. Not for any real reasons, just because he did not like a few things. He did not stay on and try to change things or fight, he just pulled the plug. No one forced him out. He did not like the phone quality, or the stream quality, or the numbers of listeners - none of which should be a deal breaker - all of which could be worked on.

Just to correct you on one thing.
Art does not own any domain associated with "Dark Matter" and neither does he own any right to the name of "Dark Matter" as there was already a podcast by the name of Dark Matters.

The only domain Art does own is the ArtBell.com domain.

Right, I was thinking he was using the DM domain. The fact the podcast existed doesn't mean he can't own the name though, he would have to register it and perhaps trademark it, but it can be done.

So, maybe no one owns the DM name, who knows. They are not still calling his time slot DM I assume?

I just think he got tired of it and didnt wanna continue (regardless of what happend)
